Terms of Service

1. Acceptance of Terms

By submitting a booking form, making a payment, or using our services in any capacity, you confirm that you have read, understood, and agree to these Terms of Service. If you are booking on behalf of a business or third party, you represent that you have the authority to bind that entity to these terms.

2. Services

513Shutter provides professional real estate photography, aerial/drone photography, virtual tours, and related visual media services in the greater Cincinnati metropolitan area and surrounding regions. Specific deliverables for each package are as described on our Pricing page at the time of booking.

We reserve the right to modify or discontinue service offerings at any time. Changes will not affect bookings already confirmed in writing.

3. Booking & Scheduling

A booking is confirmed only once you receive a written confirmation from us by email. Submitting a booking form does not guarantee a session date.

• Session times are subject to availability and weather conditions.
• You are responsible for ensuring the property is ready for photography at the confirmed time — this includes staging, lighting, and access.
• If the property is not ready at the scheduled time, we reserve the right to reschedule and may charge a rescheduling fee.
• Drone/aerial services are weather-dependent and may be rescheduled at no charge if conditions are unsafe.

4. Cancellation Policy

Cancellations by you

• 48+ hours before the session: Full refund or free reschedule.
• 24–48 hours before the session: 50% refund or one free reschedule.
• Less than 24 hours before the session: No refund. We will offer one reschedule at our discretion.

Cancellations by 513Shutter

In the rare event that we must cancel due to illness, emergency, or equipment failure, we will notify you as soon as possible and offer a full refund or priority rescheduling.

5. Payment Terms

Payment is collected in person on the day of your shoot. We accept cash, Zelle, and card. Sessions are booked via Calendly — no upfront payment is required at the time of booking.

• Payment is due at the time of booking unless otherwise agreed in writing.
• Prices are in US dollars and inclusive of applicable taxes unless stated otherwise.
• Rush delivery (within 12 hours of session completion) may incur an additional fee, agreed upon in advance.
• Chargebacks initiated without first contacting us to resolve an issue may result in termination of service and recovery of fees.

6. Copyright & Usage Rights

513Shutter retains the copyright to all photographs and media produced. Upon receipt of full payment, we grant the client a non-exclusive, non-transferable licence to use the delivered images for the purposes stated below.

Permitted uses

• Listing the property on MLS platforms and real estate websites.
• Marketing the property via print or digital channels.
• Social media promotion of the specific property.
• Sharing with potential buyers during the sale period.

Not permitted without written consent

• Reselling or sublicensing images to third parties.
• Using images for advertising your business or brand beyond the specific property listing.
• Altering or removing watermarks or metadata.
• Using images after the property is sold for purposes unrelated to historical documentation.

513Shutter reserves the right to use delivered images in our portfolio, website, and marketing materials unless you notify us in writing before the session that you require confidentiality.

7. Delivery

Edited photos will be delivered via an online gallery link within 24 hours of the session for standard bookings unless a different timeline is agreed in advance. Gallery links expire after 90 days. Please download and save your images promptly.

Minor re-editing requests (exposure, white balance) are accommodated at no charge within 7 days of delivery. Significant re-shoots require a new booking.

8. Property Access & Client Responsibilities

• You are responsible for obtaining all necessary permissions to photograph the property, including owner, HOA, or tenant approval.
• All pets should be secured and spaces cleared of personal items not intended to appear in photos.
• Any hazardous conditions at the property must be disclosed before the session.
• 513Shutter is not liable for any damage to the property or its contents during the session absent gross negligence on our part.

9. Limitation of Liability

To the maximum extent permitted by law, 513Shutter's total liability for any claim arising from these terms or our services shall not exceed the amount paid by you for the specific session giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost sales, or missed deadlines caused by factors outside our control (weather, equipment failure, force majeure).

10. Governing Law

These Terms of Service are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Hamilton County, Ohio.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
